1 Acceptance of Terms

By signing up for a membership, attending classes, or using any IronFist MMA facilities, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you are under 18 years of age, a parent or guardian must read and agree to these terms on your behalf.

We reserve the right to refuse service to anyone for any reason at any time.

2 Membership Terms

2.1 Eligibility

To become a member, you must:

• Be at least 16 years of age (18 for certain advanced classes)
• Complete and sign all required registration forms
• Provide valid identification
• Complete a physical activity readiness questionnaire (PAR-Q)
• Have no medical conditions that would make martial arts training unsafe

2.2 Membership Types

We offer various membership types:

• Monthly Membership: Automatically renews each month until cancelled
• Annual Membership: 12-month commitment with discounted rate
• Class Packs: Pre-paid sessions with expiration dates
• Private Training: One-on-one sessions scheduled separately

2.3 Membership Freeze

Members may freeze their membership for medical reasons or extended travel with proper documentation. Freeze requests require 7 days notice and are subject to a $15 monthly freeze fee. Maximum freeze period is 90 days per calendar year.

3 Payment Terms

3.1 Fees and Charges

• Membership fees are due in advance
• Late payments incur a $25 late fee
• Returned payments incur a $35 NSF fee
• Annual memberships are non-refundable
• Prices are subject to change with 30 days notice

3.2 Billing

We require a valid credit card or bank account for automatic billing. You authorize IronFist MMA to charge the provided payment method for all fees, taxes, and other charges.

Billing occurs on the same date each month (or annually for annual memberships). If your payment method fails, we may suspend your membership until payment is received.

3.3 Refunds

Membership fees are non-refundable except as required by law. Class packs are non-refundable and non-transferable. Private training sessions cancelled with less than 24 hours notice are forfeited.

4 Liability Waiver & Assumption of Risk

4.1 Assumption of Risk

You acknowledge that martial arts training, including but not limited to boxing, MMA, BJJ, kickboxing, and self-defense, involves inherent risks including:

• Broken bones, fractures, sprains, and strains
• Concussions and head injuries
• Cuts, bruises, and abrasions
• Serious permanent disability or death

You voluntarily assume all risks associated with training at IronFist MMA.

4.2 Release of Liability

To the maximum extent permitted by law, you release IronFist MMA, its owners, employees, instructors, and agents from any and all liability for:

• Any injury, loss, or damage to person or property
• Any act or omission, whether negligent or otherwise
• Claims arising from your participation in any activities

4.3 Medical Condition Disclosure

You must disclose any pre-existing medical conditions, injuries, or limitations. You agree to consult with a physician before beginning any training program if you have any concerns about your ability to participate safely.

5 Code of Conduct

5.1 General Rules

All members must:

• Treat all members, staff, and equipment with respect
• Maintain proper hygiene (clean gear, trimmed nails, etc.)
• Follow instructor directions at all times
• Use equipment only for its intended purpose
• Clean up after themselves

5.2 Prohibited Behavior

The following may result in immediate termination of membership without refund:

• Fighting outside of supervised training
• Use of profanity, harassment, or discrimination
• Arriving under the influence of drugs or alcohol
• Theft or vandalism of property
• Inappropriate contact with minors
• Posting inappropriate content about the gym or members online

5.3 Training Safety

• No unsupervised sparring
• Must wear required safety gear during contact training
• Tap out immediately when caught in a submission
• Respect training partners' limits and experience levels
• Report all injuries immediately to staff

6 Cancellation Policy

6.1 Membership Cancellation

To cancel your monthly membership:

• Submit written notice via email to billing@ironfistmma.com
• Provide 30 days notice before next billing cycle
• Complete and sign cancellation form at front desk

Cancellation requests by phone or in-person without written confirmation are not valid.

6.2 Early Termination Fees

Annual memberships terminated early are subject to:

• Remaining balance of contract (if paid annually)
• Early termination fee equal to 2 months membership
• Any outstanding charges or fees

6.3 Gym Closure or Relocation

In the event of temporary closure (renovations, emergencies) or permanent relocation beyond 15 miles, members will be notified of options including pro-rated refunds or membership transfer.

7 Privacy & Data Protection

7.1 Information Collection

We collect personal information including:

• Contact information (name, address, phone, email)
• Payment information
• Emergency contact details
• Health and fitness information
• Attendance records

7.2 Use of Information

Your information is used to:

• Process payments and manage your account
• Communicate about classes, events, and schedule changes
• Ensure safe training environment
• Improve our services
• Comply with legal obligations

7.3 Photography & Video

IronFist MMA may photograph or record videos for:

• Marketing and promotional materials
• Social media content
• Instructional purposes
• Security monitoring

By using our facilities, you consent to such recording. If you do not wish to be photographed, notify us in writing.

8 Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be:

• Posted on our website with updated "Last Updated" date
• Emailed to current members 30 days before changes take effect
• Available at the front desk

Your continued use of our services after changes constitutes acceptance of the modified terms.

Mandatory Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration in Combat City, CC, in accordance with the American Arbitration Association rules.

Class Action Waiver: You waive any right to participate in class actions or representative proceedings.

Governing Law: These Terms are governed by the laws of the State of Combat City.

9.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
